This article reflects upon the increasingly popular claim that animals are persons. Such a claim can take a metaphysical, a moral, or a legal meaning. Animals may or may not be persons, but I challenge the assumption that it is even fruitful to think about the ways in which animals are “persons.” At best, it is a relatively narrow assimilationist conceptual exercise. At worst, it distracts us from conceptualizing more effective strategies to improve the welfare of animals and impoverishes more (...) promising avenues of philosophical investigation on interspecies relations and on the nature and moral status of both animals and human beings. I offer a principled objection to arguments in favour of legalizing non-voluntary euthanasia on the basis of the principle of beneficence. The objection is that the status of death as a benefit to people who cannot formulate a desire to die is more problematic than pain management care. I ground this objection on epistemic and political arguments. Namely, I argue that death is relatively more unknowable, and the benefits it confers more subjectively debatable, than pain management. I am not primarily (...) referring to the claim that it is difficult to make comparisons between live and post-mortem states, but rather to the fact that it is epistemically and metaphysically problematic to impute a “life-worse-than-death” or a state of “suffering-calling-for-death” to people who cannot subjectively wish to die, as though this kind of suffering were a medically observable fact rather than a belief- and value-laden notion. On the contrary, people enduring similar causes of pain may have different experiences of suffering and views on how it affects the worthwhileness of their existence or the desirability of death or of continuing their lives. The projection of a “suffering-calling-for-death” onto infants or people with severe intellectual disabilities may not be indefensible, but it is more controversial than judging that pain management will improve their well-being from the perspective of beneficence. My argument also relies on our society’s liberal endeavour to avoid endorsing unverifiable beliefs about life and death or controversial conceptions of the good life. My goal is not to suggest we should not attend the suffering of cognitively disabled people. On the contrary, I only cast doubt on too quick an assumption that ending their lives is the best way of caring for them, when robust palliative treatments are available. Moreover, I express the concern that a lack of attention to distinctions between “pain-calling-for-relief” and “suffering-calling-for-death” may be based on ableist projections and assumptions. I conclude that it is imperative to continue research into the nature of pain and suffering experienced by individuals with mental or cognitive impairments preventing them from expressing autonomous wishes about the kind of treatment that would most benefit them. Aspiration by Agnes Callard locates standing assumptions in the theory of rationality, moral psychology and autonomy that preclude the possibility of working to acquire new values. The book also explains what changes need to be made if we are to make room for this form of agency, which I call aspiration.

This paper seeks to determine the extent to which individuals with borderline personality disorders can be held morally responsible for a particular subset of their actions: disproportionate anger, aggressions and displays of temper. The rationale for focusing on these aspects lies in their widespread acknowledgment in the literature and their plausible primary association with blame directed at BPD patients. BPD individuals are indeed typically perceived as “difficult patients” (Sulzer 2015, Bodner et al. 2011), significantly more so than schizophrenic or depressive (...) patients (Markam 2003). The “responsibility question” for patients with BPD has already been raised (Martin 2010, Zachar & Potter 2009, Bray 2003), but this paper tackles it from a novel perspective. First, I narrow down the category of things for which the responsibility question is specific to individual with BPD. After that, I argue that some of the diagnosis criteria of BPD such as emotional instability or impulsivity might serve as excusing factors targeting the “control condition” on moral responsibility. Second, this paper also considers another widely accepted condition on moral responsibility: the epistemic condition. The view defended in the paper is that the answer to the responsibility question for individuals with BPD, concerning both the control condition and the epistemic condition, hinges on an understanding of their epistemic profile. In particular, posting data to researcher-approved information systems is increasingly recognised as a legitimate form of publication. This implies that models for evaluation and recognition are being brought into question and new models are being proposed. Ils sont indissociables du contexte qui les a vu naître : celui d’une baisse record du nombre de mariages et de naissances, pour lesquelles les autorités désignent comme coupables les « personnes qui vivent seules » (o‑hitori‑sama). Philosophers have argued that stakes affect knowledge: a given amount of evidence may suffice for knowledge if the stakes are low, but not if the stakes are high. By contrast, empirical work on the influence of stakes on ordinary knowledge ascriptions has been divided along methodological lines: “evidence‐fixed” prompts rarely find stakes effects, while “evidence‐seeking” prompts consistently find them. We present a cross‐cultural study using both evidence‐fixed and evidence‐seeking prompts with a diverse sample of 17 populations in 11 countries, speaking (...) 14 languages. Our study is the first to use an evidence‐seeking prompt cross‐culturally, and includes several previously untested populations (including indigenous populations). Across cultures, we do not find evidence of a stakes effect with our evidence‐fixed prompt, but do with our evidence‐seeking prompt. We argue that the divergent results reveal a tension within folk epistemology: people's beliefs about when it is appropriate to ascribe knowledge differ significantly from their actual practice in ascribing knowledge. The strategy of developing an ontology or models of disability as a prior step to settling ethical issues regarding disabilities is highly problematic for two reasons. First, key definitional aspects of disability are normative and cannot helpfully be made value-neutral. Second, if we accept that the contested concept of disability is value-laden, it is far from obvious that there are definitive reasons for choosing one interpretation of the concept over another. I conclude that the concept of disability is better left (...) ethically open-ended or broad enough to encompass the examination of various ethical issues. Alternatively, the concept of disability could be altogether abandoned in order to focus on specific issues without being hindered by debates about the nature of disability. Only political costs, rather than conceptual considerations internal to the models, could be weighed against such a conclusion. (shrink)

The increasing complexity of human subjects research and its oversight has prompted researchers, as well as institutional review boards, to have a forum in which to discuss challenging or novel ethical issues not fully addressed by regulations. Research ethics consultation services provide such a forum. In this article, we rely on the experiences of a national Research Ethics Consultation Collaborative that collected more than 350 research ethics consultations in a repository and published 18 challenging cases with accompanying ethical commentaries to (...) highlight four contexts in which REC can be a valuable resource. REC assists: 1) investigators before and after the regulatory review; 2) investigators, IRBs, and other research administrators facing challenging and novel ethical issues; 3) IRBs and investigators with the increasing challenges of informed consent and risk/benefit analysis; and 4) in providing flexible and collaborative assistance to overcome study hurdles, mediate conflicts within a team, or directly engage with research participants. Institutions that have established, or plan to establish, REC services should work to raise the visibility of their service and engage in open communication with existing clinical ethics consult services as well as the IRB. While the IRB system remains the foundation for the ethical review of research, REC can be a valuable service for investigators, regulators, and research participants aligned with the goal of supporting ethical research. Social contract theories generally predicate the authority of rules that govern society on the idea that these rules are the product of a contractual agreement struck between members of society. These theories embody values, such as equality, reciprocity and rationality, that are highly prized within our culture. Yet a closer inspection reveals that these features exclude other important values, relations and even persons from the realm of contractual morality and justice, especially people with severe intellectual disabilities. Jonas-Sébastien Beaudry explores (...) the moral status of intellectually disabled people in social contract thought and argues that this tradition needs to be revisited to include the most vulnerable. Addressing this problem will have concrete repercussions in law and policy, because many issues that people with disabilities face are connected to deeply rooted assumptions about their status as full citizens or full members of our moral, political and legal communities. My aim in this paper is twofold: to distinguish two notions of naturalness employed in beyond the standard model physics and to argue that recognizing this distinction has methodological consequences. One notion of naturalness is an “autonomy of scales” requirement: it prohibits sensitive dependence of an effective field theory’s low-energy observables on precise specification of the theory’s description of cutoff-scale physics. I will argue that considerations from the general structure of effective field theory provide justification for the role this notion (...) of naturalness has played in BSM model construction. A second, distinct notion construes naturalness as a statistical principle requiring that the values of the parameters in an effective field theory be “likely” given some appropriately chosen measure on some appropriately circumscribed space of models. I argue that these two notions are historically and conceptually related but are motivated by distinct theoretical considerations and admit of distinct kinds of solution. (shrink)

Of the various loci of systematic theology that call for sustained philosophical investigation, the doctrine of sanctification stands out as a prime candidate. In response to that call, William Alston developed three models of the sanctifying work of the Holy Spirit: the fiat model, the interpersonal model, and the sharing model. In response to Alston’s argument for the sharing model, this paper offers grounds for a reconsideration of the interpersonal model. We close with a discussion of some of the implications (...) of one’s understanding of the transforming work of the Holy Spirit for practical Christian spirituality. (shrink)

Freud, Psychoanalysis and Symbolism offers an innovative general theory of symbolism, derived from Freud's psychoanalytic theory and relocated within mainstream scientific psychology. It is the first systematic investigation of the development of Freud's treatment of symbolism throughout his published works, and discovers in those writings a broad theory which is far superior to the widely accepted, narrow, 'official' view. Agnes Petocz argues that the treatment of symbolism must begin with the identification and clarification of a set of logical constraints (...) and psychological requirements which any general theory of symbolism must respect, and that these requirements have been neglected by existing accounts across a number of disciplines. Her newly proposed 'Freudian broad' theory of symbolism, by contrast, does meet these requirements, but only after it has been rehabilitated within a revised psychoanalytic context, encompassing major changes to our understanding of the concepts of unconscious and repression and the role of language. Methodologically rigorous description, analysis, and critique of postmodern phenomena presuppose a rigorous theory of postmodernity, for which the philosophy of Martin Heidegger holds great untapped promise. This essay explicates the basic content of Heidegger’s “metametaphysics,” since for Heidegger a “metaphysics” is the epochally prevailing projection of the meaning of being in general, and he offers a theory of Western metaphysics. I begin with Heidegger’s analysis of the “regional ontologies” of the sciences in his 1927 magnum opus Being and Time, since (...) the metametaphysical works of the “late middle” Heidegger in the 1930s–1940s extend this analytical framework to metaphysics as global ontology. I then explicate Heidegger’s views on modern metaphysics, focusing on his analyses of modern science and the philosophy of Descartes, before turning to his theory of postmodernity, which I extract from his analyses of modern technology and the philosophy of Nietzsche. A lively debate in the literature on moral progress concerns the role of practical reasoning: Does it enable or subvert moral progress? Rationalists believe that moral reasoning enables moral progress, because it helps enhance objectivity in thinking, overcome unruly sentiments, and open our minds to new possibilities. By contrast, skeptics argue that moral reasoning subverts moral progress. Citing growing empirical research on bias, they show that objectivity is an illusion and that moral reasoning merely rationalizes pre-existing biased moral norms. In (...) this article, I argue that both the rationalists and the skeptics fail to understand fully the role of practical reasoning by focusing exclusively on moral reasoning to the neglect of social reasoning. In the first half of the article, I argue against the skeptics by vindicating moral reasoning. I identify a Democratic Model of moral reasoning which is reliable and effective in overcoming bias. In the second part of the article, I argue against the rationalists. Drawing on a paradigmatic case of moral progress, i.e., the British abolition of the slave trade, I illustrate that moral reasoning, even when sound, is insufficient to motivate progressive action. The explanation for this puzzling phenomenon is not that the moral norm against cruelty is inert, as skeptics might suggest. Rather, it is that the moral norm against cruelty was overridden by the social norm of slavery which was tied to the British joint commitments to freedom and national honour. The debate between rationalists and skeptics centers around the moral rationality of human action, failing to recognize that human action is in fact primarily about social rationality. I defend a joint commitment account of social rationality, and offer a novel Communitarian Model of social reasoning which follows the logic of social rationality to revise social norms. I defend the reliability and efficacy of the Communitarian Model of social reasoning by applying it to the abolitionist social movement to show how Britons gave fellow Britons social reasons grounded in their joint commitments to freedom and national honour to end slavery. Many appraisal theories claim that appraisal causes emotion. Critics have rejected this claim because they believe (a) it is incompatible with the claim that appraisal is a part of emotion, (b) it is not empirically supported, (c) it is circular and hence nonempirical, and (d) there are alternative causes. I reply that (a) the causal claim is incompatible with the part claim on some but not all interpretations of the causal claim and the part claim, (b) the lack of empirical (...) support can be remedied, (c) there may even be ways to cope with the circularity problem, and (d) it is unclear to what extent the alternative causes differ from appraisal. Agnes Arber's international reputation is due in part to her exceptional ability to interpret the German tradition of scholarship for the English-speaking world. The Mind and the Eye is an erudite book, revealing its author's familiarity with philosophy from Plato and Aristotle through Aquinas to Kant and Hegel; but it is not dull, because the quiet enthusiasm of the author shines through. In this book she turns from the work of a specialist in one science to those wider questions (...) which any scientist must ask at intervals. What, in short, is the relationship between the eye that sees and the mind that weighs and pronounces? An important feature of this Cambridge Science Classics reissue is the introduction provided by Professor P. R. Bell, who as a Cambridge botany student at the time that Agnes Arber was writing The Natural Philosopby of Plant Form, is uniquely able to set The Mind and the Eye in the context of contemporary biological research. In this paper, I try to resolve a contradiction arising from the combination of two theses: (1) self-forgiveness is sometimes morally justified and (2) only victims can rightly forgive. As has been pointed out by other philosophers, both are plausible but the two taken together are inconsistent. In the literature, self-forgiveness is painted as an “imperfect” form of forgiveness or as a “second best option” because it entails a violation of the victim’s prerogative to forgive. So far, this view has (...) not directly been challenged and philosophers have focused on the task of giving a plausible account of self-forgiveness while leaving the claim according to which forgiveness is among the victim’s prerogative unchallenged. I argue that self-forgiveness is largely independent from the victim’s forgiveness both morally and conceptually. (shrink)
